General terms and conditions of use (GTCU)

Article 1. Purpose
The purpose of these general terms and conditions of use - hereinafter referred to as the "GTCU" - is to provide a legal framework for the use of the https://www.bicycode.eu/ website (hereinafter referred to as the "Site") and its services.
The contract is concluded between :
BICYCODE, a simplified joint stock company with a single shareholder and capital of €14,482.00.

And
Any individual or legal entity, public or private, accessing and using the Site and its services, hereinafter referred to as the "User".
Access to and use of the Site are subject to the prior reading and full acceptance of these GCU, which apply to any variation or extension of the Site on existing or future social and/or community networks. By browsing the site, you acknowledge that you have read and fully accept, without reservation, these GCU. In the event of disagreement with all or part of these conditions, the User may not use the Site.
The use of bike management platforms for bike owners https://moncompte.bicycode.eu/se-connecter and for professionals https://pro.bicycode.eu/se-connecter are subject to specific Terms and Conditions for each site and must be consulted before browsing.
Article 2. Access and navigation
Bicycode implements reasonable technical solutions at its disposal to allow access to the site 24 hours a day and 7 days a week.
For the proper management of the Website, Bicycode may at any time:
- Suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or to certain parts of the Site, to a specific category of Internet users;
- Delete any information that could disrupt its operation or contravene national or international laws, or the rules of Netiquette,
- Suspend the Site in order to carry out updates, or in the event of force majeure.
All costs incurred in accessing the Site (computer, smartphone, Internet connection, etc.) are the responsibility of the User.
Article 3. Responsibility of Bicycode
Bicycode is only responsible for the content it has published.
Bicycode uses its best endeavours to ensure that the information and updates on its Website are reliable. The information contained on this Site is as accurate as possible and the Site is periodically updated, but may contain inaccuracies, omissions or gaps.
Any User who notices a shortcoming, an error or a possible malfunction may report it by e-mail to the following address: contact@bicycode.com or by using the contact form.
Bicycode cannot be held responsible for any material damage related to the use of the Website. In addition, the user of the Site undertakes to access the Site using recent, virus-free equipment with an up-to-date, latest-generation browser.
Bicycode will not be held responsible for damage caused by a virus, server bugs, or damage caused to the User by a third party or in cases of force majeure.
Bicycode shall not be liable for any damages of any kind resulting from its unavailability.
Article 4. Responsibility of the User
The User remains fully and personally responsible for the equipment enabling him to access the Site and for the use he makes of the Site and its services.
The User must take all necessary precautions to prevent any damage to or malfunction of the Site.
The User must not attempt to interfere with the proper operation of the site, and must refrain from, among other things, any reverse-engineering data extraction techniques.
Article 5. Intellectual property rights
All content on the Site, including but not limited to graphics, images, texts, videos, animations, sounds, logos, gifs and icons, as well as their formatting, are the exclusive property of Bicycode, with the exception of trademarks, logos or content belonging to other partners or authors.
Access to the Site does not constitute recognition of a right and, in general, does not confer any intellectual property right relating to the elements of the Site, which remain the exclusive property of Bicycode.
The information on the Site is available for personal use or consultation only, unless otherwise expressly agreed by Bicycode.
Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these various elements is strictly forbidden without the express written consent of Bicycode.
Any infringement of Bicycode's intellectual property rights constitutes an infringement punishable by the French Intellectual Property Code.

Article 6. Protection of personal data
Personal data is protected by law no. 78-17 of January 6, 1978, articles 323-1 et seq. of the French Criminal Code and the European Data Protection Regulation 2016/679 of April 27, 2016 (RGPD).
Bicycode has drawn up a data protection policy.
Article 7. Cookie management
Browsing the https://www.bicycode.eu/ website may cause cookies to be installed on the user's computer. A cookie is a small file which does not allow the user to be identified, but which records information relating to the navigation of a computer on a site. The data obtained in this way is intended to facilitate subsequent browsing of the site, and is also used to measure visitor numbers.

Article 8. Hypertext links
The Site may contain hypertext links to other websites over which Bicycode has no control. Despite prior and regular checks by Bicycode, the latter declines all responsibility for the content that may be found on these sites.
Bicycode authorizes the creation of hypertext links to any page or document on its Website, provided that such links are not created for commercial or advertising purposes.
In addition, the prior information and acceptance of Bicycode is required before setting up any hypertext link. The following are excluded from this authorization: sites disseminating information of an illicit, polemical, pornographic, xenophobic or homophobic nature, or any other site inciting hatred or violence.
Finally, Bicycode reserves the right to remove at any time a hyperlink pointing to its Website if it deems it to be inconsistent with its editorial policy.
Article 9. Changes to the general conditions of use
Bicycode reserves the right to modify, at any time and without prior notice, the Website and the services as well as these Terms and Conditions, in particular to adapt to changes in the Website by providing new features or removing or modifying existing features.
The User is therefore advised to refer to the latest version of the GCU, which can be accessed at any time on the Site, prior to any browsing. In the event of disagreement with the GCU, the User may not use the Site.
Article 10. Applicable law and competent jurisdiction
The present Terms of Use are governed by French law.
In the event of a dispute arising out of or in connection with these TOU, the parties agree to seek to resolve the dispute through negotiation or other appropriate dispute resolution process, before resorting to legal action.
The User is informed that, in case of dispute, he may contact Bicycode at contact@bicycode.com.
In the event of a dispute, and failing amicable agreement, the dispute will be brought before the French courts in accordance with the rules of jurisdiction in force.
